Tax records and owner control: what to agree before listing

Good owner onboarding makes the money trail clear and puts availability, use, kilometres, handover, and exit rights into the written agreement.

How can vehicle rental income be treated for Thai tax?

A Thai Revenue Department ruling on a vehicle lease classified the rent as assessable rental income under Section 40(5)(a). In that ruling's facts, the corporate payer also had a 5% withholding obligation. Your result can depend on the parties, contract, residence, ownership, and payment structure.

This guide does not calculate personal tax. Owners should keep the signed agreement, payment statements, bank records, withholding certificates where issued, and relevant expense evidence, then confirm the filing treatment with a qualified Thai adviser.

Do not treat a net bank transfer as the complete tax record. The gross amount, any withholding, adjustments, and payment period should be identifiable from the statement or supporting documents.

Which payment records should an owner keep?

Keep a record for each booking period showing the vehicle, rental dates, customer rental revenue used for the split, owner percentage, adjustments, withholding if applicable, and net payment. Keep the related agreement and bank receipt so each amount can be traced.

Agreement

The signed terms should define rental revenue, owner share, payment schedule, refunds, costs, damage funds, and tax handling.

Owner statement

A period statement should show the calculation from booked rental activity to the amount payable to the owner.

Tax evidence

Keep withholding certificates and other documents relevant to the owner's filing position where they are issued.

Expense evidence

Keep invoices and receipts for costs your adviser says are relevant. Do not assume every vehicle expense is deductible.

Who controls when the vehicle is available?

The owner should approve the availability process before launch. The agreement needs a clear calendar method, notice period, rules for existing bookings, blackout dates, and the consequences of withdrawing a vehicle after a booking has been accepted.

Control works only when the operational rule is specific. Agree how the owner blocks dates, how quickly NOIRR confirms a request, and when an accepted booking becomes binding under the agreement.

Which use limits belong in writing?

Write down approved renter criteria, licence requirements, geographic area, border restrictions, prohibited activities, daily or pooled kilometres, excess kilometre charges, fuel or charging rules, smoking, pets, additional drivers, parking, tracker use, and return condition.

The exact limits must match the vehicle, insurance confirmation, and commercial agreement. A website summary should never override the signed terms for a particular owner vehicle.

How should handover, maintenance, and exit work?

Define who stores and moves the vehicle, checks condition, holds keys, approves maintenance, handles recalls, pauses bookings, and pays for ordinary wear or exceptional damage. Also define notice, outstanding bookings, final inspection, document return, data retention, and listing removal when the relationship ends.

Handover

Record mileage, fuel or charge, condition, accessories, keys, and authority to release the vehicle.

Maintenance

Set service intervals, approval thresholds, downtime rules, tyre standards, warning-light response, and recall handling.

Tracking and data

Explain any tracker, who can access location data, the purpose, retention, and how the owner can make a data request.

Exit

State the notice period, treatment of accepted bookings, final settlement, return of keys and records, and removal of public content.
