Commercial insurance and damage: questions to settle before a rental

A personal motor policy, compulsory road protection, and paid self-drive rental are not interchangeable. The exact use and policy wording matter.

Why is written confirmation necessary?

Insurance is determined by the contract, endorsements, declared use, driver conditions, and facts of the incident. A label such as first-class insurance does not, by itself, answer whether a privately owned vehicle may be supplied for paid self-drive rental.

The Office of Insurance Commission's motor policy interpretation handbook discusses rental or hire use as an increase in risk where a vehicle was insured for personal use. That is why NOIRR asks for the actual policy documents and written confirmation for the proposed use.

Confirmation should identify the vehicle, policy number, who may drive, how renters are approved, allowed territory, permitted use, theft treatment, excesses, and whether the owner, platform, or renter must notify the insurer after an event.

What protection should an owner ask about?

Ask separate questions about injury protection, third-party property, damage to your own vehicle, theft or misappropriation, flood and natural hazards, glass, tyres, keys, towing, loss of use, and legal defence. One covered category does not prove that every other category is covered.

Vehicle damage

Confirm whether collision damage to the owner vehicle is covered during paid rental, what excess applies, and who may authorise repairs.

Theft and possession

Ask how theft, failure to return, fraud, and misappropriation are distinguished. These events may be treated differently in policy wording.

Third parties

Confirm liability limits and exclusions for injury or damage to other people and property. Compulsory protection should not be confused with comprehensive vehicle cover.

Use restrictions

Check driver age, licence class, named-driver conditions, geographic limits, prohibited roads, track use, commercial use, and cross-border travel.

How should vehicle condition be recorded?

Create a time-stamped condition record at every handover and return. Photograph every side, wheels, glass, cabin, dashboard, fuel or charge level, mileage, keys, accessories, and existing marks. Both parties should be able to see what changed during the rental.

A condition record does not decide insurance coverage, but it makes the facts easier to establish. Keep original files and record the date, location, renter acknowledgment, and any immediate report made to NOIRR, police, insurer, or broker.

What happens when damage is reported?

The first priorities are safety, emergency assistance where needed, prompt notice, and preserving evidence. The incident should then follow the insurer's instructions and the signed agreement. NOIRR must not promise that a deposit or policy will cover every loss before the facts are reviewed.

1. Make the situation safe

Stop further damage, contact emergency services when necessary, and do not agree liability on behalf of an insurer.

2. Record the facts

Capture vehicles, plates, drivers, witnesses, location, time, damage, and official reports where relevant.

3. Notify promptly

Tell NOIRR and follow the insurer or broker's reporting instructions without unnecessary delay.

4. Assess responsibility

The agreement, evidence, insurer decision, deposit terms, and applicable law determine how a particular loss is handled.

What should the owner agreement say about damage?

The agreement should state the deposit, authorised deductions, evidence standard, inspection method, reporting deadlines, repair approval, excess responsibility, uninsured losses, loss of use, traffic fines, keys, tyres, cleaning, and dispute process. Any insurance statement should match written insurer confirmation.

A large deposit is not the same as insurance. A policy is not a guarantee of payment. Clear records and a clear agreement reduce ambiguity, but each incident still depends on its own facts.

Insurance and damage questions

Is first-class insurance automatically enough?

No. The policy schedule, wording, endorsements, declared use, and driver conditions must be checked for the actual paid rental arrangement.

Does the renter deposit replace insurance?

No. A deposit is contractual security up to its available amount and permitted uses. It does not create insurance coverage or guarantee full recovery.

Who decides whether a claim is covered?

The insurer assesses coverage under the policy and incident facts. Contractual responsibility between owner, NOIRR, and renter is a related but separate question.

Should I rely on a telephone assurance from an insurer?

Ask for written confirmation that identifies the vehicle and proposed paid self-drive rental use. Keep the response with the policy documents.
